Comparative Study and Enlightenment of Chinese and Foreign Legal Policies on Personal Data Protection under the Background of Generative Artificial Intelligence
Under the background of Generative Artificial Intelligence (GenAI), conducting quantitative evaluation and comparative analysis of Chinese and foreign legal policies on personal data protection can provide valuable references for China to strengthen its personal data risk governance capabilities in the application of GenAI. This study uses the Latent Dirichlet Allocation (LDA) topic model to mine topics from 39 legal policy texts, combines existing research results to design an evaluation system for personal data protection legal policies under the GenAI background, and employs the Policy Modeling Consistency (PMC) index model to quantitatively evaluate 29 implemented legal policy texts. Subsequently, it compares the policy differences among China, the United States, the United Kingdom, and the European Union in terms of policy functional positioning, implementation logic, and system completeness. Based on the comparative results, this study summarizes enlightenment for China from three aspects: balancing security and development, strengthening agile governance models, and optimizing a multi-stakeholder collaborative pattern, aiming to provide references for improving China's personal data protection level under the GenAI background.
