谁是中国沿海滩涂的所有者？
Who is the Owner of China's Tidal Flats?
长期以来，我国沿海滩涂产权纠纷层出不穷。本文收集了1949年以来有关沿海滩涂所有权的一系列法律法规，梳理滩涂产权归属的历史变迁，发现沿海滩涂的所有权问题比较复杂，不能以国有或集体所有概而论之；法律一直规定滩涂既有国有、也有集体所有；历史上我国几次试图将滩涂全盘国有化，但最终都回到滩涂既有国有也有集体所有的轨道上。最后，本文建议：第一，尽快清理法律混乱；第二，先确定滩涂所有权，再谈是否能够占用、怎么占用；第三，加快推进沿海滩涂所有权的确权登记发证工作。
here has been a lot of property rights disputes concerning tidal flats in China. This paper collects a series of document on institutional change of the ownership of tidal flats, and find that: (1) the ownership of tidal flats is complex and cannot be concluded as state-owned or collectively owned. (2) Chines law has long institutionalized that tiadal flats can be state-owned or collectively owned; (3) The central government tried several times to nationalize tidal flat but failed consecutively. Finally, the paper provides some policy recommendations on clarifying the ownership of tidal flats in China.
